How Do You Get Compensation in a Mass Tort?

A mass tort case allows multiple plaintiffs to band together, share resources, discuss evidence, and form a "group" that wants to sue the same defendant or defendants for their damages. However, when a mass tort is approved, each plaintiff is referred back to their local courts to begin and manage an individual claim. By this method, every mass tort plaintiff can win or lose their case independently of the outcomes of any other case.

In contrast, a class action lawsuit takes all eligible plaintiffs and forms them into a single plaintiff class. A single case is managed for that class, so there might only be the need for one trial or one settlement. If the class wins, then everyone in the class wins, too, but the same is true if the class loses. Furthermore, if the class wins, then any recovered compensation is split among all class members, with the possibility that the lead plaintiffs will receive more than others.
