Failure to provide safe premise: Big Lots being sued after fall

One moment is often all it takes to change the course of a person's life. Maryland residents may be interested in one woman's claims that a series of moments have resulted in pain, surgeries and expensive therapy. She is accusing the store Big Lots Inc. of failure to provide safe premise after she suffered a fall from a patch of dirt.

According to store video footage, the store cashier can be seen sweeping near the checkout station but had stopped sweeping to help a customer. Following the interaction, a 58-year-old woman approached the checkout station. She claims to have lost her balance on a patch of dirt and can be seen in the video losing falling toward a display stand. In the video, the woman continued to check out, but only used her uninjured arm, which her attorney cites as evidence of an injury.

After visiting a doctor 10 days following the fall, the woman was diagnosed with a torn meniscus in her knee and a torn rotator cuff in her shoulder. She underwent surgeries and therapy for both injuries. Attorneys for Big Lots claim that the 10-day wait to visit a doctor and pre-existing injuries to both areas of her body were more likely the cause of her pain and injuries than the fall in the store. At the time of the report, the case was being heard by a jury and its outcome was pending.
