Man suffers traumatic brain injuries after fall at deli

Numerous building codes exist for personal homes, public buildings and businesses to ensure the safety of the occupants or visitors in Maryland. When codes are neglected, serious safety hazards may be present and serious slip-and-fall accidents can occur. Sadly, an elderly man suffered traumatic brain injuries believed to be a result of neglected building codes.

The elderly man was on the premises of a deli when his accident occurred. The deli occupied a building owned by a separate company who was responsible for maintaining the premises. Just outside of the building, the man fell and hit his head on the sidewalk, suffering a serious subdural hematoma. His injury resulted in two brain surgeries, weeks in the hospital and approximately eight days in a rehabilitation facility.

The man sued the deli and the building owner for the injuries he suffered. The building owner is accused of not providing a handrail and ramp, and not properly marking a step as required building safety codes. A judge and jury determined that the building owner was liable for the man's injuries and awarded the man $244,544. Part of the money will be automatically allocated to reimburse the medical expenses Medicare covered on the man's behalf. Although the deli has since closed, the building is reportedly still owned by the same manager and has not been brought up to code.
